The Power to Declare War

According to the Constitution, Congress has the power to declare war, though it does not explain what format or what kind of legislation is necessary for declaring wars. Although Congress has only formally declared war five times — the last time being World War II –many constitutionalists believe that this is the only legal way for the nation to engage in war and that every battle begun directly under the authority of the president was unconstitutional.

Based on this, Bush’s Authorization for Use of Military Force Against Iraq Resolution of 2002 was challenged by a coalition of U.S. soldiers, parents of U.S. soldiers, and members of Congress prior to the invasion to stop it from happening in the case of Doe vs. Bush. The First Circuit Court of Appeals ruled in favor of Bush, with
Judge Lynch pointing out that, “They base this argument on two theories. They argue that Congress and the President are in collision — that the President is about to act in violation of the October Resolution. They also argue that Congress and the President are in collusion — that Congress has handed over to the President its exclusive power to declare war.”

I’ve been hearing the argument for a Congressional declaration of war a lot lately from liberals, including one of my favorite bloggers Glenn Greenwald, who correctly pointed out that Obama himself said that the president in fact does not have the right to declare war unless the United States is at risk.

The reason I’ve never jumped on to this argument is that the members of Congress obviously don’t want to be the ones to declare war. Ezra Klein of the Washington Post explains as much. That may be a sad state of affairs, but even if it is a Constitutional requirement, you can’t carry water for people who don’t want to drink. It reminds me of the “state’s rights” argument: you can complain that Federal power is taking state power away, but it never really causes anyone to argue that their beliefs should only be effectual in one state. If you’re Pro-Life, then you want abortion outlawed federally. If you’re Pro-Choice, you want abortion to be legal in all 50 states. So until Congress actually starts demanding the power to declare wars, it’s really just a tangent to the more important question of whether the particular war you’re talking about is a good or bad idea.

Which leaves only one thing. Mark Kirk doesn’t feel the need to regulate carbon or get off of fossil fuels because Al Gore got a divorce. Time to update the We’re All Gonna Die By pool and change the odds on “drowning”. Thanks, assholes!”

What the Heck’s Been Going on in Egypt?

Cory asks: Can you sum up what the heck’s been going on in egypt?

The revolution in Egypt was inspired by the revolution in Tunisia (also in Northern Africa). The revolution in Tunisia was sparked off when a vendor had his vegetable cart confiscated by a female police officer and was unable to get it back, which caused the man to burn himself to death in protest. The Tunisian revolution also inspired protests in neighboring Algeria.

The overarching cause of the increasing strife is anger over corruption, fixed elections, and the disparity of wealth. The disparity of wealth is actually much larger in the United States, but 40% of Egypt lives on $2 a day. While this global financial crisis, like all the others, was caused by banking institutions and the super-rich, the super-poor end up paying the consequences. Also, just like in Saudi Arabia and Iran, over half the population is under 30, plus there’s rampant unemployment, and the internet is making it harder for the dictatorship to quash all dissenting opinion. A Google executive recently released from Egyptian captivity is cited as helping the revolution, and Facebook and Twitter are helping people organize.

Like most totalitarian dictatorships, Egypt was an ally, so a lot of Paleo-Conservatives are angry at Obama for taking the side of the protestors, while Neo-Conservatives are stepping up and praising Bush for helping bring about the conditions that made regime change seem possible to the masses. Many people are scared the “Muslim Brotherhood” is going to take over, but they are a comparatively minor player and have been very quiet since the protests began. Glenn Beck thinks that it’s being caused by a conspiracy between Islamists and Communists.

The protests started the day after I watched the movie Agora, which is about Christians rioting in Egypt during the early 400s A.D. I definitely recommend it.

My Question for Matt Taibbi

Matt Taibbi recently offered to start answering some questions as a part of a weekly mailbag. I sent in one about global warming and it got posted to his column:

Matt,
I was wondering on what your take on global warming ever since your piece on how cap and trade will profit Goldman Sachs. Most of what I read about it makes me think the IPCC is too conservative and is low-balling most of the dangers, which in turn gets ignored or sidelined by the mainstream media. Do you think that global warming is only “maybe” a danger or do you agree with what the majority of climate scientists and other science bodies say about it? Do you support a direct tax on gas?

Jeff,
My problem with cap and trade isn’t that I don’t believe in global warming — I do — but that cap and trade is basically a carbon tax, except that instead of simply collecting the tax the government plans on privatizing the effort into the hands of a bunch of financial companies who have long records of manipulating exactly the kinds of commodities markets the carbon-credit market will be modeled after. It’ll be a massive financial subsidy to companies like Goldman and Morgan Stanley, as if they needed another one.
